Washington State Passes Legislation Banning Animal Testing

Washington state is taking a significant step toward cruelty-free cosmetics with a proposed bill aimed at banning animal testing for cosmetics. According to a report from the Animal Legal Defense Fund, H.B. 1097, if passed, would prevent manufacturers from selling or offering for sale any cosmetic products that have been developed or tested on animals in Washington state starting January 1, 2025.

The legislation allows for a few specific exemptions. For example, if animal testing occurred outside the United States to comply with foreign regulatory requirements, as long as the test results are not used to substantiate the safety of the cosmetic ingredient or product sold in Washington. Additionally, testing conducted for cosmetics that fall under specific federal regulations, such as those governed by 21 U.S.C. Sec. 351 et seq., would also be exempt.

In cases where cosmetics or their ingredients were tested on animals before January 1, 2025, but no new animal testing is conducted after that date, they would also remain exempt from the ban. This provision would apply even if the products are manufactured after the new law takes effect. Manufacturers found in violation of the law could face fines of up to $5,000 per violation.
